Une fois de plus, l’actualité achoppe sur une question de vocabulaire. Le conflit d’intérêt a un sens assez peu précis, et pas de fondement juridique en France où on parle de « prise illégale d’intérêt ». La très intéressante dépêche de l’AFP ci-dessous évoque les réglementations en vigueur dans les autres pays d’Europe.

PARIS — Plusieurs pays comme le Canada et les pays nordiques se sont dotés de règles ou d’organismes chargés de l’éthique des dirigeants politiques pour lutter contre les conflits d’intérêts, dérive dont l’ex-ministre du Budget Eric Woerth se voit accusé en France.
M. Woerth est accusé de conflits d’intérêts alors que des enregistrements pirates font apparaître des liens troubles entre l’héritière de l’Oréal Liliane Bettencourt et le couple Woerth, l’épouse du ministre ayant travaillé pour une entreprise gérant la fortune de la milliardaire. M. Woerth est aussi critiqué pour cumuler depuis 2007 les fonctions de trésorier de l’UMP avec celles de ministre du Budget puis du Travail.
En France, seule la décision prise qui conduirait à un intérêt personnel (« prise illégale d’intérêt ») est condamnable. Dans de nombreux pays, le simple fait de se trouver en position de conflit peut être sanctionné et provoquer le départ d’un responsable politique, relève l’association de lutte contre la corruption Transparency International.
Selon la définition du Conseil de l’Europe, « un conflit d’intérêt naît d’une situation dans laquelle un agent public a un intérêt personnel de nature à influer ou paraître influer sur l’exercice impartial et objectif de ses fonctions officielles ».
En 2005, l’Organisation de coopération et de développement économiques (OCDE) a formulé des recommandations prévoyant notamment que les responsables doivent « limiter les opérations, les intérêts privés, les relations personnelles et affiliations qui pourraient compromettre des décisions officielles dans lesquelles ils sont impliqués ».
Là où ce n’est pas faisable, un responsable « devrait s’abstenir de toute implication dans des décisions officielles qui entrent en conflit avec ses intérêts personnels », dit l’OCDE.
Certains pays ont appliqué ces recommandations comme la Norvège qui a édicté dès 2005 un « code de conduite ». En cas de risque de conflit d’intérêts, il y est d’usage, comme en Finlande, qu’un ministre se récuse lui-même et s’abstienne de participer à une décision. En Suède, le code administratif prévoit les mêmes restrictions, incluant l’activité des conjoints.
Le Canada s’est lui doté d’un « commissariat aux conflits d’intérêts et à l’éthique » qui dispose de pouvoir d’enquêtes.
Dans d’autres pays, le débat est récurrent, comme en Italie où le chef du gouvernement Silvio Berlusconi contrôle notamment le groupe de télévision Mediaset et l’éditeur Mondadori. Depuis 2004, une loi interdit notamment aux membres du gouvernement de participer à une délibération du conseil des ministres en cas de conflit d’intérêt.
Au Royaume-Uni, où la législation n’interdit pas aux députés de travailler pour des clients privés mais les oblige à déclarer tout revenu, plusieurs scandales ont éclaté. L’un des derniers en date a visé en mars d’anciens ministres travaillistes qui avaient été filmés en caméra cachée exigeant 5.000 livres pour influencer le gouvernement.
Polémique aussi en Allemagne où la presse a révélé début 2010 qu’un richissime hôtelier avait versé un don d’un million d’euros pour la campagne des libéraux du FDP au pouvoir, alors que l’une des toutes premières mesures du nouveau gouvernement a été d’alléger la TVA dans ce secteur.
Plus récemment, le ministre FDP des Affaires étrangères Guido Westerwelle a déclenché une tempête, accusé par l’opposition de se faire accompagner dans ses voyages officiels d’hommes d’affaires proches de sa famille ou mécènes de son parti. Son compagnon a également été accusé de profiter des déplacements officiels pour prospecter pour son activité de promoteur sportif.
